Can You Get Arrested For Non-Nude Child Images?

Can you get arrested for non-nude images of children? Well, it depends. In this informative video, I discuss how certain images, illustrations, and even writings can rise to the level of child sex abuse images (child pornography) depending on several important factors. Also discussed in the video is the Dost Test and the Miller Test. These are important cases that the courts use to determine if images display “sexually explicit conduct.”

In addition, on February 25, 2016, the Eleventh Circuit joined the Eighth, Tenth, and Ninth Circuits in finding that “lascivious exhibition” can be expanded to include the actions of the producer of the depiction.
